From AFSCME Retiree President Larry Brown on Pensions Dear John, My name is Larry Brown and I am the new president of AFSCME Retirees Chapter 31. I have been a member, first of AFSCME, and now of AFSCME Retirees, for nearly 35 years and have been serving as the president of the Chester retiree subchapter for the past eight years. I’m very honored to have been elected as your president by the delegates to the recent Chapter 31 biennial convention at such a critical time for retirees in our state. I’m also very saddened to tell you of the passing of my predecessor in this office, Virginia Yates. Virginia served as our president for six years with unwavering commitment and determination. She also served on the boards of SERS, the Illinois Alliance of Retired Americans, AFSCME Council 31 and the national AFSCME Retirees. She was a fighter who never gave up, no matter how tough the challenge. We always knew we could count on her to stand up for dignity and security for all retirees. She will be greatly missed. I’m writing you today about two matters important to your well-being—your pension and your health care. As a SERS retiree, you know that the so-called pension “reform” legislation passed last week by the General Assembly and signed into law by Governor Quinn could have very dire consequences for your retirement security. The legislation passed by a very close vote over vocal opposition from many legislators, massive grassroots pressure from union members and retirees all across the state, and an intensive Capitol lobbying offensive by AFSCME and our partners in the We Are One Illinois union coalition. You can be proud of the fact that for more than two years AFSCME active and retired members—along with our We Are One partners—have beat back repeated attempts to make even more draconian cuts to pension benefits. Now the fight must shift to the courts. AFSCME and our partners in the We Are One Illinois coalition have authorized coalition attorneys to move forward with filing a lawsuit to challenge the constitutionality of SB 1. The new law is scheduled to go into effect on July 1, 2014. However, the coalition will be asking the court for a stay of the implementation pending a ruling on its constitutionality. While the lawsuit is likely to be lengthy and very expensive, this legal battle is absolutely essential. If the courts uphold the constitutionality of SB 1, then you can be virtually certain that politicians will try to continue to chop away at pension benefits in the years to come. That’s why it’s so important that your legislators hear from you over the coming days. If they voted right (NO), be sure to call and thank them. If they voted “YES” to slash your pension, be sure to let them know how disappointed in them you are. You can call on the We Are One hotline at 888-412-6570. Or you can click here to send an email message to your legislators. Click here to see the roll calls of how legislators voted. You can click here to access an interactive tool that will help you determine how this new law will impact you. You should be aware of several important facts: The amount of your current pension benefit will not be reduced. In fact, even if the new law goes into effect, your benefit amount will increase on the date upon which a cost-of-living adjustment (COLA) would normally be implemented. HOWEVER, in most cases the amount of the COLA that is added to your pension will be LESS than it would have been had this law not been passed. For instance, under the new law if you retired from the state with 25 years of service and you now have a pension of $40,000, your COLA would be calculated on $20,000 (25x$800), rather than the full $40,000. So next year you would still receive a COLA, bringing your pension to $40,600. However, if the law had not been enacted, your pension next year would have been $41,200. That’s $600 lost in one year—and that loss increases exponentially, rising to thousands of dollars over the next five years. Some retirees who have a lower pension benefit will not be impacted at all by this new law. Depending on the combination of your years of service and the amount of your pension, there may be no reduction to your COLA. For instance, if you retired with 30 years of service and your current annual retirement annuity is $24,000 (30x$800) or less, your COLA would not be reduced. We are hopeful that the courts will stay the implementation of this law until there is a clear ruling regarding its constitutionality. We are also hopeful that our union coalition will prevail in court on the constitutional challenge. However, you should be aware that if at any point this law is implemented, AFSCME Retirees Chapter 31 will provide you with further information to help you understand how it will impact your retirement income. We also wanted to remind you that the deadline for returning your TRAIL (Total Retiree Advantage Illinois) Open Enrollment Form for the current retiree health care benefit choice period is December 13—this Friday. AFSCME has urged CMS to extend the deadline to ensure that all retirees have the opportunity to make informed choices. But to be safe, if you haven’t already returned the form, it’s best to do so right away. Please note that CMS has extended the deadline for return of the Dependent Verification Audit form until January 31. We know this is a very difficult time for retirees like you. The assault on the retirement benefits promised to you is unrelenting. We want you to know that Retirees Chapter 31 is out there every day fighting against this assault and doing everything possible to ensure that retirement security remains a reality for retired public service workers in Illinois.
